The Problems With Wall Street

First off, let me say up front that I AM NOT a stockbroker. I do not trust them, as the person exists today. And I do not play the market, nor do I invest in the market at this time. And here is why.

The stock market used to be used for LONG-TERM investments, not the short-term as it appears to be the case today as I see it. And there are WAY too many EXPERTS, who although they may have a lot of education have no real common sense. As I watch some of the programs on satellite TV, I am just blown away by this or that expert who makes a comment about a company and that company’s stock raises or falls. Who are these people and how much do they REALLY know. Do they have time to dig into a company? Have they taken the time to really see what makes it tick?

Are they aware that by making the wrong statements how many people whose lives that they might mess up? And what about all of the insider trading and stock manipulation? Why is it that Wall Street and the SEC are so slow to correct these problems? To me the biggest problems stem from the “day trader”. The market seems to be concerned about the “FAST BUCK”, not on real growth.

So. How can we fix the system? There is no real way unless investment firms take a strong hand in correcting the problems I have discussed. Now, I know that things are being worked on. But the problems should not have happened in the first place. INTEGRITY is the key. Not greed. (I do not care what Mike Douglas said in the movie “Wall Street”, today’s stockbroker seems to care very little about what they sell, or who buys it. All they seem to care about is, ”What’s in it for me?” And some of the people who manipulate the market seem to be even worse.

Also it seems as if Wall Street does not care about what a company plans to do long term. If a company announces that it will spend x% of profit on new research, or to update equipment, then that company gets pounded on the market because some people seem to thinks that ALL profits should go to the investors. For any company to stay on top of the game, a company MUST plan for the future. Brokerage firms have so many different categories to rate a company. Now I know what they mean, but it should be simplified. Here’s why. Wall Street is chomping at the bit, and lobbing like crazy to do away with the Social Security System, so that they can get their hands on the cash in the system. (This is a broad statement, because there is no real cash in a separate account, but you get the idea.) And what they will do is drain it dry by charging fat fees to handle our accounts. So, a stock should have only two categories, buy, or sell. Period.  I say all of this for several reasons.
   

1.)

Brokers are like lawyers in that you can never be sure if they are telling the truth. Because after all, they are only worried about their bottom-line not ours. If we go belly up, well then, they just get someone else. 

2.)

I learned a long time ago that to play the market, only use money that you could throw away. So if the market has more than 50 % of your nest egg in it, you could be in real trouble.

3.)

Now, I know that over the long term the market has a much better return that say U.S Savings Bonds, or other ways to save. But what if YOU are ready to retire just as the market takes a huge downturn before you can change things.

4.)

Wall Street firms MUST act as if the funds, and accounts that they are handling are their very own. ANY FIRM that does not act in a fair manner toward its customers should be penalized, and made to make restitution. After the second time, they should be stripped of their credentials, and no member of the firm should be allowed to act in ANY capacity in any other firm. The head of these firms should act responsibly. In the military a ships Captain, or a company commander are held responsible for the actions of those under them, because it was on the their watch. The same set of standards should apply.

If all of this sounds cruel, or harsh, you must think of what is at stake here. We cannot afford to have another Enron situation happen again. Again, I am no expert. But maybe some one will see this and take one of these ideas or thoughts and expand on it. Or maybe someone who has some real power will read this and see some truth of what I am talking about. 09/11/2001 was an attempt to break our will as a nation by destroying the financial heart of our country. I am a very strong believer in our free enterprise system. I support the system. But if we keep shooting ourselves in the foot, we will destroy our country from within.

The Plight of the American Worker

When an employee is hired to work at any company in this country, that person knows that they must perform. They must do the very best that they can EVERY single day, or they may be reprimanded or fired. When raises or promotions come up any mistakes may come back to haunt them. They will not get a raise, bonus, and may even get laid off when the company has to make cutbacks. Or if they are an outstanding worker, it may make no difference when the lower ranked managers have to cut more than they want to. When the CEO'S of companies in this country screw up they lay off the work force. Then, if they continue to screw up, they get fired.

But here's the BIG difference. They get HUGE severance packages. This is something that has gone on LONG enough. But this is America and the government does not believe in dictating to business. So how do we police business in this country? Companies are supposed to police themselves, but it does not seem to be working. Politicians in this country (read that mostly Republicans) have long said that there are too many rules, laws, and regulations that are hindering businesses from hiring more workers, and paying them.

Well I have news for EVERYONE.

If business in this country, large or small where to operate in a moral and ethical manner,(that means following the Golden Rule) then we would have NO NEED for 95 % of ALL the laws and rules that are on the books right now !!!!!! People whose only retirement is a 401K plan have lost everything because the company faced no controls or very limited controls on the running of that 401K. So here are some of my ideas on how to fix things.

    1. Company Executives MUST first answer to BOTH shareholders AND employees, because with out the latter, the former does not make a dime.

    2. Stop the use of bonus payments in the form of stock options, because senior management (Board of Director's included) will only work to fatten their wallets, not the shareholders.

    3. Abolish any and all forms of stock payments to the employee's as a way to keep them. If the employee wishes to purchase company stock, let them do so at a discount of say 25-50 %.

    4. Make ALL pension funds come under the same ERISA rules. Force the company to treat the plan as it should treated, as the employee's nest egg, not money that the company can steal.

    5. Any finally, the last one. For the past decade this country has been fed lies. We have been told that the American worker will change careers every 5-7 years. Who has been feeding us that? The very same people who now want to dismantle the Social Security System. The people of Wall Street, Big Business & Politicians. (The last ones are in the pockets of the first two) And why is this happening? Well, it is this way. Most company pension plans work very similar to the way the Social Security System works, in that your last 5 years has the most impact on the size of your pension. Is it strange then that is the same time frame that an employee ALSO makes the MOST money when they work for that same company? So if a company can eliminate that cost, then that extra money can then go into the company profits. (READ THAT AS A BONUS TO THE BOSS) So why should a person HAVE to change their career? So we do away with the Traveling 401K plan. This is the plan that will eliminate SSI and replace it with a plan that the employee will have to take care of (And who will educate the workforce of this country on how best to manage this plan, and who will PAY for that skill?)

This may sound like the ravings of a madman, and if so, I will accept those comments. I have lost my job because of the things that I have been talking about. I am almost 52 years old, with 2 teenage daughters. And I have several nieces, and nephews who although they have some college and are no dummies, they do not have the skills to deal with what I am talking about. So, who will speak for them, and the rest of those just like them? How can we protect the workforce that is coming behind us? We dare not trust the ones in office now, or the heads of business now either.

Three Stikes Law

I don't know how many of you know about the three strikes law, but it is a great one.  In California when certain criminals are arrested for multiple violent crimes, they can be given strikes for their offenses.   Once the offenders receive a total of 3 strikes, they are sentence to jail for life.  The criminals think that this is a tough law, and they are right!  The only downside to this law is that the criminals can only stay in jail for life, and not longer.

A recent episode of 60 minutes aired a spot on this law and highlighted an individual who was arrested for stealing a pizza and was sentenced to life in prison.  This story brought a lot of sympathy to the issue, but nonetheless the criminal deserves the time.  I feel that if a criminal gets caught three times for violent crimes, then he has actually committed many more than this.  

I know people who have been the victims of crimes committed in California, and I know people who are committed crimes in California.  Even though I know people on both sides of this issue, I am not swayed in my opinion that this law is great and should exist forever.  I do not propose that traffic violators get the death penalty, but for real hardened criminals, they deserve to remain in jail forever.
 

Rebuttal - Three Stikes Law

Dear Sir:
 
I would like to discuss three strikes showing some points of view drastically opposed to yours but not opposed to your purpose of protecting Society from crime.
 
Before all, I would like to say that I am more a man of "law and order" than an anarchist nor a leftist human rights militant.
 
My point of view is pragmatic.  I don't base my ideas in a pity to criminals, but I think they would render a better service to us if we give them the chance to repentant ad conversion.
 
Let's get to the point.
 
I agree that a person who is a dangerous real enemy of society should not be free.  This means not necessarily in jail, as I think you could have someone under custody without being jailed.  Electronic controls could do the job.  I have read than in Scandinavian countries these methods are successfully used.
 
But the three strikes law is not - as far as I understand it - discriminating between dangerous and not dangerous - even repentant - people.
 
I think that this is inhuman.  Justice is not punishment but giving to everyone the possibility to receive what he deserves.  And under Christ's law - we both live in Christian countries, so I take Christian values as worthy even if you should have another or any religion - everyone deserves pardon, not only three times, but seventy times seven, that is, infinitely.
 
A repentant man is not a bad one, so he must not be jailed or even punished forever.  He should be given another chance of changing his life and even to work for more justice in the world.
 
This seems to be an utopia point of view, but I believe in utopia solutions.  In fact I am currently working on my doctoral thesis in Social Psychology in Argentina on this subject, in order to prove that systematic punishment creates more harm than protection to Society.
 
"The miserables" novel of French writer Victor Hugo illustrates very well this issue at the beginning of the story of Jean Valjean, a man jailed for nineteenth year for stealing a piece of bread (not a piece of pizza as the man you want in jail forever) and than pardoned when, after his release, he steals a lot of silver pieces in the house of a good-natured and compassionate bishop.  He transforms himself after this pardon in a wonderful person.
 
Milton H. Erickson, a famous psychotherapist and hypnotherapist, is telling us the true story of a Mr. Joe in Jeffrey Zeig's books "A seminar with Milton Erickson".  Joe was a criminal and was several times jailed and cruelly punished for his behavior.  But he found a girl who believed in his capacity of being a gentleman.  He not only converted himself in a gentleman, but was also a remarkable man of good heart and noble actions since then.  He only needed someone to trust him.
 
Please think about Goethe's sentence (ironically this sentence is written in the main inner door of a major jail in Buenos Aires):  "If you take people as they are you will push them to be worse than they are;  if you take them as what they might be, you will help them to get there where they must arrive".
 
Don't you think that we take criminals just as being criminals?  ¿Why do we wonder that they become mostly worse than criminals?
 
Please, reconsider your extreme punishment position.

Environmental Hazard

The republicans are so bad for our environment!  All they want to do is make it easy for businesses to make money and compete globally.  The republicans know that they can only get into office with the support of big business and big money.  Because of this they have opened up to big business at the expense of our natural resourcese in America.  We, as Americans, must put a stop to this crazy agenda that the Republicans have.  If they can win a real election without big dollars, then do they deserve it? After all our water and air becomes more poluted everyday, and we are all suffering because of non-environmentally friendly policies passes by republican politicians.

I urge all Americans to write to their congress person, to put a stop to the reckless handling of our natural resources here in America.  And I am including our clean air and clean water in this.  If we can't find a better way to live, then we will suffer today, but our children will really feel the effects of this terrible handling of this beautiful country.
